These Terms of Service ("Terms") govern your access to and use of the SPiR Health mobile application ("SPiR," "the App," "we," "us," or "our").

By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.

1. Description of the Service

SPiR Health is a habit, routine, and wellness optimization platform that enables users to:

• Set daily intentions and select habits
• Organize routines using a Body Clock–Calendar interface
• Track habits, streaks, and XP
• Use optional wellness tools (breathing, soundscapes, focus timers, fasting clocks)
• View progress and consistency metrics

SPiR provides educational and self-management tools only.

2. Eligibility

You must be at least 18 years old to use SPiR Health.

By using the App, you represent that:

• You are legally permitted to use the App
• You have the authority to enter into these Terms
• You will comply with all applicable laws

3. Not Medical Advice (Critical)

SPiR Health does not provide medical advice.

The App:

• Does not diagnose, treat, cure, or prevent disease
• Does not replace professional medical judgment
• Does not provide clinical or therapeutic services

All content, insights, and tools are for educational and informational purposes only.

You are solely responsible for decisions regarding your health, habits, routines, and behaviors. Always consult a qualified healthcare professional before making health-related changes.

4. User Accounts

To access certain features, you may be required to create an account.

You agree to:

• Provide accurate and current information
• Maintain the security of your login credentials
• Accept responsibility for all activity under your account

SPiR is not responsible for unauthorized access caused by your failure to safeguard credentials.

5. User Responsibilities & Assumption of Risk

You acknowledge and agree that:

• Habit completion, routines, and XP are self-reported
• Outcomes vary by individual consistency, biology, and context
• SPiR does not guarantee results, performance improvements, or outcomes
• You assume all risks associated with your use of the App
• You remain fully responsible for your actions and interpretations of App insights

6. Acceptable Use

You agree not to:

• Misuse the App or use it for unlawful purposes
• Attempt to reverse engineer, scrape, or exploit the App
• Interfere with App security, servers, or infrastructure
• Misrepresent SPiR as a medical, diagnostic, or clinical service
• Use SPiR in a way that could cause harm to yourself or others

Violation may result in suspension or termination.

7. Subscriptions, Billing & Payments

If SPiR offers paid features:

• Payments are processed through Google Play
• Pricing and billing terms are disclosed at purchase
• Subscriptions auto-renew unless canceled via Google Play
• Refunds are governed by Google Play policies and applicable law
• SPiR does not manage payment credentials directly

8. Intellectual Property

All content, systems, designs, features, algorithms, visuals, copy, and trademarks in SPiR are owned by SPiR Health or its licensors.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes only.

You may not:

• Copy, modify, distribute, or resell the App
• Use SPiR IP without written permission

9. Third-Party Services & Integrations

SPiR may integrate with third-party platforms (e.g., wearables, calendars).

SPiR:

• Does not control third-party services
• Is not responsible for their accuracy, uptime, or data practices
• Is not liable for issues originating outside the App

Use of third-party services is governed by their own terms.

10. Data & Privacy

Your use of SPiR is subject to the Privacy Policy, which explains how data is collected, used, and protected.

By using the App, you consent to data practices described in the Privacy Policy.

11. Disclaimers

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE."

TO THE MAXIMUM EXTENT PERMITTED BY LAW, SPiR DISCLAIMS ALL WARRANTIES, INCLUDING:

• Implied warranties of merchantability
• Fitness for a particular purpose
• Non-infringement

SPiR does not warrant uninterrupted or error-free operation.

12. Limitation of Liability

To the maximum extent permitted by law:

SPiR Health shall not be liable for:

• Personal injury
• Health outcomes
• Loss of data
• Indirect, incidental, consequential, or punitive damages

Total liability shall not exceed the amount you paid (if any) to use the App in the preceding 12 months.

13. Termination

We may suspend or terminate your access to SPiR at any time if:

• You violate these Terms
• You misuse the App
• Required by law or platform policy

You may stop using the App at any time.

14. Modifications to the Terms

We may update these Terms periodically. Changes will be reflected by the "Last Updated" date.

Continued use of the App constitutes acceptance of revised Terms.

15. Governing Law

These Terms are governed by the laws of the State of New Jersey, USA, without regard to conflict-of-law principles.
